By downloading, accessing, or using Spark AI, you agree to these Terms of Use. If you don’t agree, please don’t use the App.

1) Apple EULA and these Terms

If you downloaded the App from the Apple App Store, your use of the App is also governed by Apple’s Standard Licensed Application End User License Agreement, unless a custom license agreement is presented in App Store Connect.

These Terms supplement the Apple license agreement and cover areas not included in the standard agreement, such as AI features, user content rules, and subscription terms. If there’s a conflict, the Apple agreement controls for the parts it covers.

2) Who we are (and who Apple is not)

These Terms are an agreement between you and Vertex Studios. Apple is not responsible for the App or its content, and Apple has no obligation to provide support for the App beyond what the App Store requires.

3) Eligibility

You must be at least 13 years old or the minimum age required in your country to use the App. If you’re under the age of majority, you confirm you have permission from a parent or guardian.

4) What the App does

Spark AI provides AI-assisted features to help users draft messages, analyze conversations, and generate suggestions. The App’s output may be incomplete, inaccurate, or not appropriate for every situation.

You are responsible for how you use the App and what you choose to send to others.

5) User content and AI processing

a) Content you submit

User Content includes the text you enter and any screenshots you upload.

b) Screenshot processing via Mistral AI

If you upload a screenshot for analysis, you agree that we may transmit it to Mistral AI to process your request and generate an AI response.

Uploaded screenshots are used for processing only and are not stored in our database.

We do not sell your screenshots or use them for advertising.

c) Your responsibility

Don’t upload content you don’t have the right to share, or content that includes highly sensitive personal information.

6) Acceptable use rules

You agree not to use the App to:

Harass, threaten, bully, defame, or invade someone’s privacy
Generate or share content that is illegal or promotes illegal activity
Generate sexual content involving minors (zero tolerance)
Attempt to reverse engineer, disrupt, or exploit the App or its systems
Circumvent security, abuse rate limits, or misuse the service
Use the App in a way that violates any applicable law or regulation

We may suspend or terminate access if we believe you violated these Terms.

7) Subscriptions and billing (Apple App Store)

If the App offers paid features through auto-renewable subscriptions, the following applies:

Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
Your account may be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription in Settings > Apple ID > Subscriptions on your device.
Prices and durations are shown on the paywall/in the App Store purchase flow and may vary by country/region.

Free trials

If a free trial is offered, it converts to a paid subscription unless canceled before the trial ends. Any unused portion of a trial may be forfeited when you purchase a subscription where applicable under Apple’s rules.

Refunds

Refund requests are handled by Apple under Apple’s terms and processes.

8) No professional advice

The App may generate suggestions, explanations, or templates, but it does not provide legal, medical, financial, or professional advice. If you need professional help, consult a qualified expert.

9) Disclaimers

The App and AI outputs are provided “as is” and “as available.” We don’t guarantee:

the accuracy, reliability, or suitability of any AI output
uninterrupted or error-free operation
that outputs will meet your expectations in every case

Use your judgment before relying on or sharing generated content.

10) Limitation of liability

To the maximum extent permitted by law, Vertex Studios will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the App.

Nothing in these Terms limits liability where such limitation is not permitted by applicable law.

11) Changes, suspension, and termination

We may update the App, modify features, or discontinue parts of the service at any time.

We may suspend or terminate your access if:

you violate these Terms, or
it’s required for safety, security, or legal reasons.

12) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change, and the updated Terms will be posted on this page. Continued use after updates means you accept the updated Terms.

13) Governing law

These Terms are governed by the laws of England and Wales, unless your local consumer protection laws require otherwise.
