Agreement to Terms

By accessing and using Spark AI, you accept and agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use our application. These terms constitute a legally binding agreement between you and Vertex Studios.

User Accounts

To use Spark AI, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Keep your account information up to date
• Notify us immediately of any unauthorized access
• Not create multiple accounts or impersonate others

AI Assistant Service

Spark AI provides an AI-powered dating assistant service. You acknowledge and agree that:

• The AI provides suggestions and advice, not guaranteed outcomes
• You are solely responsible for your dating decisions and interactions
• The service is for informational and entertainment purposes
• We do not verify the identity or background of other dating app users
• Results may vary based on individual circumstances

Acceptable Use Policy

When using Spark AI, you must not:

• Use the service for illegal, harmful, or offensive purposes
• Harass, threaten, or abuse others
• Share explicit, violent, or inappropriate content
• Violate the intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use the service to spam or engage in fraudulent activities

Subscription and Payments

Spark AI may offer free and paid subscription tiers. Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees. Refunds are provided at our discretion and subject to our refund policy.

Intellectual Property

All content, features, and functionality of Spark AI, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Vertex Studios and are protected by copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

Spark AI is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, error-free, or meet your specific requirements. We are not responsible for the accuracy, reliability, or results of the AI-generated advice.

Limitation of Liability

To the maximum extent permitted by law, Vertex Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of Spark AI. Our total liability shall not exceed the amount you paid for the service in the past 12 months.

Indemnification

You agree to indemnify, defend, and hold harmless Vertex Studios and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your violation of these terms or your use of Spark AI.

Termination

We reserve the right to suspend or terminate your account and access to Spark AI at our sole discretion, without notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties, or for any other reason. You may terminate your account at any time through the app settings.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of Spark AI after changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must stop using the service.

Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these terms or your use of Spark AI shall be resolved through binding arbitration.
